Don't lose sight of the fact that you'll be justifying your actions (or inactions) to a jury most likely to be made up of non-divers who think diving is extremely dangerous. I may well be over-reacting in my caution, but I think you grossly underestimate how the non-diving public - who will most likely be the ones to sit in judgment - would view this.
