Here's a problem with that theory.. If the student performs all the required skills but can't perform the non-required skills ( ie; ditch and don) that student will pass anyway..
The agency requires that the instructor may not fail some one who fails to perform skills outside the curiculum..
So the instructor -v- agency arguement is slightly flawed..
