What would happen if dive boat captain took a group out in small craft advisory condition and a passenger got injured because of getting smashed on the head by the dive ladder? Or, what if they got hurt due to the severe pitching and rolling, like they were raised and dropped on the deck because of swell and sustained head neck or back injury. With a signed waiver and all, wouldn't the captain still be responsible for the injury to a point because he was taking the passengers out in conditions that were not safe for small craft. In this case, I think a small craft is a boat less that 68 feet in length. I asked this question in a round about way earlier but no one answerd it. Thank you.
